Injuries Involving Children

Under Texas law, special rules have been developed for accidents involving children. These rules apply to the ways in which children are compensated, as well as determining liability. Children are not held to the same standard of negligence as adults because Texas law recognizes that children do not make the same well-formed judgments as adults do. Depending upon the amount of settlement, the net settlement proceeds for the minor are either paid into the registry of the court, or paid into a structured settlement on behalf of the child.
