Thousands of Actos lawsuits have already been filed in courts across America. These claims are made by patients who have developed bladder cancer or congestive heart failure after using the drug.
Actos (pioglitazone) is an oral anti-diabetic medication used for type 2 diabetes. Its use became very popular among diabetic patients since its launch in 1999. The success of this medication in the market was such that, in 2008, it was ranked the tenth-best selling drug in America. In that year alone, Actos sales exceeded $2.4 billion.
The manufacturers of Actos were lax, however, in providing warnings about the risk of bladder cancer and heart failure with the use of the drug. When multitudes of consumers began experiencing adverse effects and the clinical manifestations of heart failure and bladder cancer, the link between Actos use and these illnesses were explored.
In 2007, the FDA required Actos to include a boxed warning for heart failure in the drug label. The warning emphasized that the drug may cause or worsen heart failure. In September 2010, the FDA announced that they would conduct a review of Actos and investigate claims of bladder cancer associated with the use of the drug. The results were announced in June 2011, in which the FDA concluded that patients who have been taking Actos for at least a year have a high risk of developing bladder cancer.
Takeda Pharmaceuticals, the manufacturer of Actos, then began including an FDA warning stating the risk for bladder cancer in the drug’s labels. The damage had been done, however, and thousands of patients have already taken the medication without knowledge of the risks that come with its use.
If you or a loved one has taken Actos for one year or longer and has developed bladder cancer or heart failure, you should consult with a lawyer about pursuing compensation for damages. You may be entitled to a claim if you were using Actos before the manufacturer included the FDA warning against the risks of developing bladder cancer, and were thus unaware of the dangers associated with the medication.
