Oilfield Accidents

Oil field accidents are unique in the sense that they quite often involve third parties. Oil field sites usually have several companies working together at the same time. For example, there is usually a general contractor and several subcontractors at an oil field work site. It is not unusual for an employee of one contractor to be injured by the negligence of an employee of another contractor. Oil field accidents generally involve Workers’ Compensation law, strict products liability, Jones Act and traditional principles of negligence. For purposes of the Jones Act, offshore drilling rigs which are moveable and which float from hole to hole (semi’s and jack-ups), are considered vessels. If that is the case, your employer will be responsible for paying your medical bills and paying you a small daily allowance during the time you are injured. In addition, you will be able to file a lawsuit against your employer (if your employer was negligent or if there was something wrong with the vessel which made it unfit for its intended purpose), to seek to recover all your damages caused by the injuries. This includes past and future economic loss, pain and suffering, mental anguish, disfigurement, loss of capacity to enjoy life, loss of the ability to perform household services and take care of yourself, and other damages recoverable under the maritime law. The Texas Workers’ Comp bar does not prevent an injured employee from suing third parties that are responsible for their injuries. This also includes manufacturers of products that are defective.
