Disease or trauma to the hip can result in injury to the joint, and when the hip joint is damaged, a hip replacement may be necessary. Hip replacement, also called arthroplasty, it is a surgical procedure involving the removal of the diseased hip joint which is substituted with a new artificial part or prosthesis.
DePuy Orthopaedics, Inc. is a division of Johnson & Johnson that designs, manufactures, markets and distributes hip implant products. On August 24, 2010, DePuy issued a recall of its ASR XL Acetabular metal-on-metal hip replacement system after patients began coming forward with complaints following surgery.
Johnson & Johnson received special clearance from the FDA in 2005 to launch the DePuy ASR XL Acetabular System into the market despite the lack of clinical trials to establish the safety of these products. By 2008, about 400 complaints have been made to the FDA, all coming from patients who received ASR hip replacements since their market release.
Finally, in March 2010, Johnson & Johnson admitted that their ASR hip implants had a high failure rate. In fact, a number of patients who received ASR hips needed revision surgery after the hip replacement procedure. This eventually prompted DePuy to recall their ASR products, although they could have done that sooner, given that the patients have already been reporting problems for two years.
Many patients have resorted to filing lawsuits against DePuy to hold the company liable for the injuries caused by their hip implants. Research data indicate that 1 in 8 patients who received DePuy ASR hips experience product failure within a five-year period. To make matters worse, even when the implant is replaced, it can leave behind harmful residue that can cause complications.
Several factors have been determined by DePuy as the reasons behind the failure of their hip replacement system. These include component loosening, component malalignment, infection, fracture of the bone, dislocation, metal sensitivity and pain. Aside from these, various problems may result from the defective implants, consisting of increased metal ion levels in the blood, bone staining, necrosis, swelling, nerve damage, tissue damage and/or muscle damage.
DePuy did not act on the initial complaints regarding their products promptly, and this has cost many patients their health. If you are one of the hundreds affected by faulty DePuy ASR hip implants, you should know that it is within your rights to file a claim for compensation.
